These Terms of Service ("Terms") govern your use of the Dance Insight service at app.fusion-arts-tech.com (the "Service"), operated by Takashi Iwagaya (d/b/a Fusion Performing Arts & Technology) ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Dance Insight lets you upload dance videos and receive automated movement analysis and feedback, and (for subscribers) save analyzed clips to a personal library. The analysis is generated automatically and is provided for informational and educational purposes only.
You must sign in to use the Service and must provide accurate information. You are responsible for activity under your account and for keeping your credentials secure. You must be at least 13 years old to use the Service. If you are under 18 (or the age of majority or digital-consent age in your country), you may use the Service only with the consent and supervision of a parent or legal guardian, who agrees to these Terms on your behalf.
You retain ownership of the videos and content you upload ("User Content"). You grant us a limited, non-exclusive license to store, process, and display your User Content solely to operate and provide the Service to you. You represent that you have the rights to upload your User Content and that it does not infringe others’ rights or violate any law.
You agree not to: upload content you don’t have the right to use; upload unlawful, harmful, or infringing content; attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service; or use the Service to violate anyone’s privacy or rights.
The Service, including its software, models, and design, is owned by us and our licensors and is protected by intellectual-property laws. These Terms do not grant you any rights in the Service other than the right to use it as permitted here.
The Service and its analysis are provided “as is” and “as available,” without warranties of any kind. Automated analysis may be incomplete or inaccurate and is not professional coaching, medical, or fitness advice. You use the results at your own discretion and risk.
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data or profits, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the claim.
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service. On termination, your right to use the Service ends; data handling follows our Privacy Policy.
We may update these Terms from time to time. We will post the updated version here and revise the “Last updated” date. Continued use after changes take effect constitutes acceptance.
These Terms are governed by the laws of Ontario, Canada, without regard to its conflict-of-laws rules.
